1. Introduction
These Terms of Sale (T&Cs) govern all the services offered by winter way., a brand founded by Lou Winter, Home Organizer and interior-design consultant.
winter way. offers premium services in interior organisation, decluttering, repurposing, arrangement and coaching, as well as complementary communication and publishing services.
winter way. is a brand operated under a business-incubator support arrangement, within the ACTICOP structure. On this basis, the services are carried out within that framework, and invoicing is handled by an authorised entity. The applicable VAT is stated on quotations and invoices.

2. Scope
These T&Cs apply to all the services offered by winter way., including in particular:
- Home organizing: sorting, decluttering, tidying and structuring of spaces
- Interior design: arrangement, layout and decorative proposals
- Repurposing of items: donation, recycling, transformation or resale
- Sale of goods: accessories, boxes, organizing products and winter way. merchandise
- Publishing and sale of content: books, guides, notebooks, educational resources (physical or digital)
- Training courses, workshops and support / coaching
- Communication and digital marketing, including affiliate marketing and content creation
- Home concierge services: preparing and enhancing spaces intended for rental*
*These services do not constitute rental management within the meaning of the French Civil Code.
Any order implies the client’s full and unreserved acceptance of these T&Cs.
3. Quotations and orders
Each service is the subject of a personalised quotation specifying: the nature of the services, the hourly or fixed rate, any travel costs, and estimates for the materials required.
The quotation is valid for 30 days from its date of issue. Any written acceptance (signature, email or payment of a deposit) constitutes full and unreserved acceptance of the quotation and of these T&Cs, and forms a contractual commitment.
4. Prices and payment terms
Prices are in euros and exclude materials. A deposit of 30% is required when the quotation is accepted. The balance is due on completion of the service. No work will be carried out until the deposit has been received. Any service performed is payable in full. Any late payment may lead to the suspension of services.
5. Additional costs
The following costs remain payable by the client: travel expenses (train, plane or long-distance); accommodation costs where necessary; materials, accessories, storage bins and organizing boxes. winter way. reserves the right to advance certain purchases, which will be re-invoiced to the client.
6. On-site services and warranties
The client guarantees: free and safe access; conditions allowing the service to proceed smoothly; their presence or availability where necessary.
winter way. cannot be held liable for pre-existing damage, hidden defects or fragilities that were not disclosed, nor for structural anomalies or installation defects discovered during the assignment.
6 bis. Accidents, damage and liability at the client’s home
winter way. undertakes to work with care, caution and professionalism at the client’s home. However, it cannot be held liable: for damage relating to a fragile, worn or poorly fixed item; for a hidden defect, structural fault or pre-existing fragility; for a cluttered environment or one presenting an undisclosed risk.
The client undertakes to disclose any particularity, constraint or fragility before the service. In the event of damage clearly attributable to winter way., an amicable solution may be proposed.
7. Repurposing and resale of items
As part of an assignment, winter way. may offer solutions for repurposing items, including: donation to partner charities, recycling, transformation or reassignment. Any item-resale service may be subject to specific conditions and a separate agreement.
8. Handling and repurposing of items outside a resale mandate
For items removed as part of the service: they are deemed to be given or transferred without consideration; no detailed inventory is drawn up, unless specifically requested by the client; winter way. may dispose of them freely (donation, recycling, repurposing); no financial compensation may be claimed, save by prior written agreement.
9. Sale of books, guides and digital content
Sales of books, guides and digital content are firm and final, except in the case of a manifest defect. Digital content is not eligible for any refund, exchange or return.
10. Withdrawal and cancellation
The client has a statutory 14-day right of withdrawal, except where the service begins early at the client’s request. After this period, the deposit paid is non-refundable. Any request to postpone must be made at least 48 hours in advance.
11. Liability
winter way. undertakes to provide a diligent, personalised service tailored to the client’s needs. How long the results last depends on the client’s involvement and on the use of the systems put in place.
winter way. cannot be held liable: for the loss or breakage of an item not explicitly entrusted to it; for errors arising from incomplete or inaccurate information provided by the client; for improper or misdirected use of the systems or materials put in place. winter way.’s liability is limited to direct damage, to the exclusion of any indirect or intangible loss. winter way. is bound by an obligation of means (best endeavours), and not an obligation of result.
12 bis. Image rights
As part of its services, winter way. may take photographs of spaces before and after its work. These images may be used for communication purposes and to showcase the work carried out, in particular on the website, social networks, the portfolio and marketing materials.
No information enabling the client to be personally identified will be disclosed without their consent. The client may object to the use of these images by making a written request before the service begins.
13. Personal data
Personal information collected in connection with the services is treated confidentially and used solely for the purposes of the business relationship. winter way. undertakes not to pass this data on to third parties without the client’s prior consent, save where legally required.
In accordance with the applicable regulations, the client has a right of access, rectification and erasure of the data concerning them, which they may exercise at any time by written request. See also the privacy policy.
14. Governing law
These T&Cs are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority. Failing agreement, the dispute will be brought before the competent courts in accordance with the ordinary rules of law.
